GENERAL: In these Official Sweepstakes Rules (“Official Rules” or “Rules”)), “You” or “Your” or “Entrant” means the person who has entered this Sweepstakes (“Sweepstakes”). By entering this Sweepstakes, You agree to be bound by the terms and conditions contained in these Official Rules. This Sweepstakes is governed by U.S. law and is subject to all applicable federal, state, and local laws and regulations.
SPONSOR: Mojo Interactive, Inc., 20 West 22nd Street, New York, NY 10010 (“Sponsor” or “Mojo”).
SWEEPSTAKES ENTRY PERIOD: This Sweepstakes will be offered on an ongoing basis and begins 10:00 AM on Thursday, March 16, 2023 and ends at 3:00 AM on March 20, 2023 (the “Entry Period”). Sponsor reserves the right to extend or shorten the Entry Period at its sole discretion. Sponsor’s clock shall be the official clock of this Sweepstakes.
Mojo assumes no responsibility for lost, late, misdirected, illegible or mutilated entries or for any computer, online, telephone, cable, network, electronic or Internet hardware or software malfunctions, failures, connections, availability, garbled or jumbled transmissions, service provider, Internet, web site, or other accessibility or availability issues, traffic congestion, or unauthorized human intervention, or any technical malfunctions that may occur. Entrants must be the authorized account holder of the e-mail address submitted at the time of entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain name associated with the submitted e-mail address.
ELIGIBILITY: This Sweepstakes is open only to legal residents of the United States who are 21 years of age or older as of the date the Sweepstakes begins. Employees of Mojo or any other company involved in the Sweepstakes, their subsidiaries, affiliates, prize suppliers, and advertising and promotional agencies, and their immediate families (spouse, parents, children, siblings and their spouses) and individuals living in the same household as such employees or their family members are ineligible. This Sweepstakes is governed by the laws of the United States and is subject to all applicable federal, state, and local laws and regulations. The Sweepstakes is void where prohibited by law.
HOW TO ENTER: Sponsor will tweet (the “Tweet”) about the Sweepstakes on its Twitter account; @Mojo. To enter this Sweepstakes, You must: follow Mojo’s Twitter account, and then retweet the Tweet to your own Twitter account and include a screenshot of a wager you made on any NCAA Basketball team offered on the Mojo application during the Entry Period (the “Wager”). Your retweet with the screenshot of your Wager must remain publicly posted throughout the Entry Period. Submissions that are hidden or removed prior to the end of the Entry Period will be void. By successfully completing and submitting all required information as directed, You will be entered in this Sweepstakes and will receive one entry (an “Entry”). Your Entry must comply with: (i) the content restrictions (as set forth in the Content Restrictions section below); and (ii) the Twitter Terms of Use available at https://twitter.com/en/tos. All information submitted online via Twitter is subject to, and will be treated in a manner consistent with, the Twitter Privacy Policy available at https://twitter.com/en/privacy. If You do not have a Twitter account, visit Twitter.com or download the free Twitter application and register in accordance with the enrollment instructions to create an account. Data and usage fees may apply to the download and use of the Twitter application. Account registration must be completed within the Entry Period to qualify for the Sweepstakes.
LIMIT ONE (1) ENTRY PER PERSON. ADDITIONAL ENTRIES BEYOND THE SPECIFIED LIMIT WILL BE VOID.
DETERMINATION OF WINNER: In the sole discretion of Sponsor, the winner will be randomly selected by Sponsor after the close of the Entry Period from among all eligible Entrants who have followed and comply with all eligibility rules. If an ineligible Entrant is randomly selected, that selection will be disregarded, and a new winner will be randomly selected. The winner who satisfies all eligibility requirements will be announced via post on the @Mojo Twitter page and notified directly via Twitter direct message (the “Notification”). The winner must reply to the Notification within seven (7) days of issuance to claim the Prize. Sponsor is not responsible for any changes to a winner’s information which may interfere with the winner receiving the Notification. In the event of a dispute concerning Entries submitted by multiple individuals using the same account, the Entry will be deemed to have been submitted by the authorized subscriber of the account used to enter this Sweepstakes. The winner may be required to submit his or her valid social security information and/or other identification to Sponsor and, unless prohibited by applicable law, may be required to execute, have notarized and/or return an Affidavit of Eligibility, Consent to Publicity, Liability Waiver, and/or federal and state tax release within seven (7) days of the date of issuance of the same. In the event that a winner fails to submit any identification required by Sponsor, fails to return the required documents within the specified time period, fails to comply with these Official Rules, fails to respond to the Notification within seven (7) days, fails to comply with all instructions in the Notification, or declines the Prize for any reason, a disqualification will result, the Prize will be forfeited, and, at Sponsor’s sole discretion and time permitting, an alternate winner may be selected from among the remaining eligible Entries.
PRIZES: There will be 1 (one) winner selected. The winner will receive two (2) tickets to the NCAA Regional Final being held at Madison Square Garden on March 25, 2023 (time to be determined) (the “Prize;” approximate value $600). The Prize cannot be exchanged for cash, and cannot be used in conjunction with any other promotion. Mojo reserves the right to substitute a Prize of equal or greater value in the event the offered Prize is unavailable. No substitution or transfer of Prize is permitted except as provided herein. All Prize details shall be determined in the sole and absolute discretion of Sponsor. The odds of winning a Prize will depend on the number of Entries Sponsor has received by the end of the Entry Period and will decrease as more Entries are received. Sponsor will strive to deliver the Prize in a reasonable amount of time after all details have been sorted. The winner is solely responsible for any federal, state, and local taxes (including income and withholding taxes) and any duties on the Prize.
GENERAL CONDITIONS: These rules set out the legally binding contract between entrant and Mojo in relation to the Sweepstakes. Entrant will be deemed to have accepted these terms by entering the Sweepstakes. All federal, state, and local taxes, fees and surcharges on prize packages are the sole responsibility of the prize winners. Prize winners may be required to execute and return an Affidavit of Eligibility/Release of Liability/Prize Acceptance Form within seven (7) days following notification. Return of any prize and/or prize notification as undeliverable or failure of any entrant to comply with any Official Rules will result in disqualification and selection of an alternate winner.
Winner grants Mojo the right to use and publish his or her legal name, image and state of residence online and in print, or any other media, in connection with the Sweepstakes. Except for winners who are residents of the State of Tennessee, acceptance of a prize constitutes permission for Mojo and its advertising and promotional agencies to use winners’ name, image, likenesses, photograph, and audio and visual recordings of winner for editorial, advertising and promotional purposes without payment of additional compensation unless prohibited by law. By entering, participant releases and holds harmless Mojo, their respective parent companies, subsidiaries, affiliates, directors, officers, employees, shareholders, attorneys, agents and representatives, advertising and promotional agencies, successors and assigns from any and all liability for any injuries, loss, claim, action, demand or damage of any kind arising from or in connection with the Sweepstakes or any prize won, any misuse or malfunction of any prize awarded, participation in any Sweepstakes related activity, or participation in the Sweepstakes.
As a condition of entering in this Sweepstakes, entrant agrees that any and all disputes that cannot be resolved between and the parties, and causes of action arising out of or connected with this Sweepstakes shall be resolved exclusively on an individual basis, without resort to any form of class action, before a court of competent jurisdiction located in New York, NY, which court shall apply the laws of the state of NY without regard for rules of conflicts of law. In any such dispute, entrant shall, under no circumstances, be entitled to claim punitive, incidental, or consequential damages, or any other damages, including attorneys’ fees, other than entrant’s actual out-of-pocket expenses (if any) associated with participating in the Sweepstakes, and entrant hereby waives all rights to have damages multiplied or increased.
CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, MOJO RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT PERMITTED BY LAW.
LIMITATIONS OF LIABILITY: Mojo is not responsible for any incorrect or inaccurate information, whether caused by web site users or by any of the equipment or programming associated with or utilized in the Sweepstakes or by any technical or human error that may occur in the processing of submissions in the Sweepstakes, including but not limited to any misprints or typographical errors. Mojo assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Mojo is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line-systems, servers or providers, computer equipment, software, failure of e-mail or players on account of technical problems or traffic congestion on the Internet or at any web site or combination thereof, including injury or damage to participants or to any other person’s computer related to or resulting from participating or downloading materials in this Sweepstakes. If, for any reason, the Sweepstakes is not capable of completion as planned, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of Mojo which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Mojo reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes.

LIST OF WINNERS: For the name of the winner of this Sweepstakes, mail a self-addressed stamped envelope with the name of this Sweepstakes to Sponsor at Sponsor’s address set forth in these Official Rules, Attn: “Winners List – Mojo Twitter NCAA Sweepstakes” and include the date of the particular Sweepstakes you are inquiring about. All requests must be received no later than thirty (30) days after the close of the Entry Period.

PRIVACY: Any personal information entrant provides will be treated in accordance with Mojo’s privacy policy, found here: mojo.com/privacy.
These terms together with our website Terms of Use and Privacy Policy constitute the whole legal agreement between entrant and Mojo with regard to any entrant’s entry in the Sweepstakes.
