Promotion Terms

Description of Promotion

Overview: Mojo’s 2023 Playoff Payout: Round Three (The Promotion) offers Eligible Users with an active and verified account a chance to be randomly selected for one of two promotion prizes. Players will earn entries into the promotion for every live (in-game) wager they place on the Celtics vs. Heat Conference Finals Series. At the end of the Series, twenty players will be selected to earn a $25 deposit promo code and one player will be selected to receive the grand prize offer. 

Promotion Period: The Promotion will begin at 9:00:00 AM ET on May 17, 2023, and will end at the conclusion of the final game of the Boston Celtics vs. Miami Heat playoff series. Eligible Games include: 

• Game 1 played on Wednesday, 5/17
• Game 2 played on Friday, 5/19
• Game 3 played on Sunday, 5/21
• Game 4 played on Tuesday, 5/23
• Game 5 (if necessary) played on Thursday, 5/25
• Game 6 (if necessary) played on Saturday, 5/27
• Game 7 (if necessary) played on Monday, 5/29

Eligible Users: The Promotion is available to all players with an active and verified account who receive an invitation to the promotion via email. Players must be at least twenty-one (21) years of age and be physically present in the state of New Jersey when placing any wager during the Promotion Period.

• OPT-IN REQUIRED: All eligible players that wish to participate in the promotion must select the OPT-IN option provided in the promotional email(s). 
• Eligible Players with previous entries in either Round One or Round Two of the Playoff Payout Raffle will be automatically opted-in to Round Three. 
• Eligible players that fail to opt-in to the promotion will not be eligible for bonus back or promotional offerings regardless of whether eligible bet requirements are met. 
• By opting in, players agree to all promotional terms and conditions set forth on the promotional email. 

Eligible Wagers: Players must place $50+ cash-only wagers on the eligible bet types listed below. Players must place eligible wagers after the tip-off and before the conclusion of each Eligible Game. Wagers placed prior to tip-off will not be counted toward the promotions. Win or lose, every newly opened trade will receive entries based on the Earning Structure below. 

• Eligible Bet Types & Earning Structure:

• Options: 2 entries per newly opened position
• Career Stocks: 2 entries per newly opened position 
• Moneyline: 1 entry per newly opened position
• Player-Specific Prop Wagers: 1 entry per newly opened position

• The earning structure is subject to change at any time to accommodate additional offerings and promotional opportunities. All changes to the structure will be communicated to participants and published on the Promotion landing page. 
• The sponsor reserves the right to include boosted entries as an incentive for specified periods of time, which will be communicated with the Eligible Users clearly through email, push notifications, and SMS text messages. 
• Players can receive a maximum of 50 entries per Eligible Game. 
• All eligible wagers, including Career Stocks, must be opened after the tip-off of an Eligible Game.
• Adding additional funds to an already existing position will not result in additional entries for the drawing. 
• All Eligible Wagers must be funded with a cash balance. 

Promotion Offer: At the conclusion of the Celtics vs. Heat Playoff Series, twenty players will be selected to receive a $25 deposit promo code. 1 eligible user will be selected to receive the Grand Prize Offer: $2,500 in free bet on the moneyline for Game 1 of the 2023 NBA Finals. The Eligible User will be able to choose which team they receive free shares for prior to tipoff. 

For Deposit Codes:

• Only entries earned during Round Three of the Playoff Payout are eligible for deposit promo code raffle. Any entries earned in Round One and Round Two will count towards the Grand Prize Offer, but will not be eligible for the deposit promo code. 
• The first twenty (20) users drawn will receive a $25 deposit code eligible for their next deposit of $25 or more. 
• Limit of one (1) promotion code per eligible player. If a user is drawn twice, a subsequent drawing will take place until twenty (20) unique users are picked. 
• Promo codes will be sent to the user within 72 hours of the conclusion of the final Eligible Game.

Grand Prize offer:

• At the conclusion of the final Eligible Game, one (1) user will be selection to receive a $2,500 in free bet on the moneyline for Game 1 of the 2023 NBA Finals. 
• The random drawing will be a cumulative raffle. All entries earned across the three (3) rounds of the Playoff Payout Promotion will be eligible for the Grand Prize offer. 
• In order to be eligible for the Grand Prize Offer, eligible users must have at least 10 entries earned cumulative across all 3 Rounds of the Promotion. 
• The Eligible User will be able to choose which team they receive free shares for prior to tipoff. 
• More information regarding the free bet will be communicated with the winner within 72 hours of the end of the promotion period. 

Eligibility to participate in Promotion

To be eligible to participate in the Promotion, You must (unless otherwise specified in Specific Promotional Terms):

• Be twenty-one (21) years of age or older
• Be legally entitled to use Our services in accordance with Our Terms of Service
• Reside within the state of New Jersey
• Have successfully completed registration on the App and opened a real money player wagering account (“Account”) in accordance with Our Terms of Service
• Satisfy any other eligibility criteria set out in the relevant sections of the Company’s Standard Promotional Terms in respect of certain general categories of Promotion
• not be an Unauthorized Person (as defined in section 6, below); (a “Qualifying Player”).
• You must not previously have opened and made a deposit into an Account on Our App.
• The Promotion may not be used in conjunction with any other Promotion unless otherwise specified in that other Promotion’s terms and conditions.

Participation in Promotion

Participation in the Promotion is voluntary. You should follow the instructions set out in the Promotion Communication, on the App landing page for that Promotion and, where appropriate, these Specific Promotional Terms. Entry into the Promotion may be used only once.

Excluded and Disqualified Players

Any person prohibited from gaming pursuant to N.J.S.A. 5:12-100n, N.J.S.A. 5:12A, including but not limited to employees of a casino licensee who are directly involved with the conduct of gaming and/or sports wagering operations, (ii) an employee of a supplier or vendor of the Group and iii) employees of the Company have administrative or privileged access to the Company’s online gaming data or systems; (collectively, “Unauthorized Persons”). If You have received communication from Us that you are not eligible to participate in any of Our Promotions.

Payment of Bonuses

Bonuses will be paid into the accounts of eligible users at any time within seven (7) days of the end of the Promotion unless otherwise specified. Your use of bonuses is subject to review for irregular playing patterns. In the event that we deem that an irregular playing pattern has taken place, we reserve the right to prevent you from cashing out the account funds and/or withhold any winnings derived from the use of the bonus.

In the event that more than one real money bonus or any excess payment is accidentally paid to a user, the Sponsor reserves the right, without prejudice to any other rights under the Rules, to seek the return of the amount of any additional real money bonus or payment from that player's Account. 

Eligible users who receive a bonus as the result of the Promotion must accept the bonus "as is" and there is no right to a cash alternative. Any transactions (e.g., chargeback fees, non-sufficient funds) that cause your account credit balance (unrestricted funds in the player account) to be negative must be paid before any individual bonus is issued. The Sponsor reserves the right to withhold bonus funds until the user’s account credit balance is zero or greater. 

Any entitlement to receive a bonus is non-transferable. Users are solely responsible for the payment of any applicable tax in relation to the relevant bonus and for any costs associated with the Bonus or its use, including without limitation the cost of complying with any requirements of applicable local law.

Publicity and Intellectual Property

By participating in the Promotion, We may ask you to cooperate in advertising, marketing, and/or publicity material and activities, at Our expense. You may also be asked (a) to wear any branded clothing or attire We may provide; and (b) to sign, if requested, an irrevocable release form allowing Us, without any compensation being payable to you, to use Your name, photograph, likeness, any comments made by or attributed to You, and to incorporate any such information and any audio/visual recording or broadcast for such promotional purposes, in any media, throughout the world.

Promotional Play Restrictions

We offer bonuses and promotions to enhance your enjoyment of our games and wagering. We, therefore, expect that you will participate in all bonuses and promotions fairly, so that our other customers too may enjoy our services. We have set out below certain types of play which we consider to be unfair and therefore be in breach of these Promotion Terms:

• Using minimal risk wagering patterns (e.g. low risk wagering, zero risk wagering or equal betting patterns)
• Using multiple accounts to obtain more than the number of bonuses or free bets permitted for each customer.
• Sharing personalized promotional offers or bonuses (i.e. promotions or bonuses available to specific customers only) received by you e.g. via email, inbox messages, links, URLs, etc. with others who were not the intended recipient. This includes accessing promotions or bonuses forwarded to you by others when you were not the intended recipient.
• Concealing your country of residence in order to access a promotion or bonus that is not available in your country of residence.
• Colluding with other customers in order to take advantage of promotions or bonuses where you are in breach of any Promotional Play Restrictions, we may be entitled to cancel any bonuses or promotions applied to your account, reclaim any bonus element of such offers and either settle bets at the correct odds, void any bet funded by a bonus, or remove any subsequent winnings. 
• We may also be entitled to levy an administration charge up to the value of the bonus, free bet, or additional payment to cover our reasonable administrative costs in respect of any such action that we take.

Currency

All references to sums of money will be in U.S. currency.

Our Liability

Except where prohibited by law, We accept no liability in relation to Your participation (or inability to participate) in the Promotion, including without limitation any use made by You of (or inability to use) any Bonus, to the maximum extent permitted by law.

If the Promotion cannot be executed as planned, including due to any technical problems or circumstances beyond Our control, We shall incur no liability and no onus or payment of any kind will be awarded.

Alteration and Termination of Promotions; Modification of the Rules

We reserve the right to alter, discontinue or terminate the Promotion, or any aspect of it, at any time, with or without notice, for any reason whatsoever, including without limitation if there has been any printing, production, distribution, or other error in the Promotion Communication or on the Platform, or where there has been an error in the preparation for or conduct of the Promotion affecting the result of the Promotion or the number of participants, or the value of claims.

‍The Rules may be modified by Us at any time by posting the modified terms on the relevant page(s) of the App. We recommend You revisit these Promotional Terms regularly. By Your continued participation in the Promotion, You accept any such modified terms.

Restrictions on Withdrawals

Bonus cash funds awarded are not transferable and cannot be substituted except in the Sponsor’s sole discretion. Bonus cash funds may only be used for wagering on your User Account. Bonus cash funds may be withdrawn from your User Account once they have met all Play Through Requirements.

General

The terms contained in this document apply to this specific promotional offer (“Promotion”) available from Mojo Interactive, Inc. (the “Company”). Together with any applicable Standard Promotional Terms and the Company’s Terms of Service, House Rules and Privacy Policy (collectively, the “Rules”). By participating in the Promotion, You are indicating You accept and agree to be bound by the Rules.

For the purposes of this Promotion, the promoter is the entity You have contracted with under the Terms of Service ("We", "Us" and "Our"). In the event of any conflict or inconsistency between these Promotional Terms, any applicable General Promotional Terms, and the Terms of Service, the Specific Promotional Terms shall prevail, followed by these Standard Promotional Terms, but only to the extent necessary to resolve such conflict or inconsistency. Your use of each Platform itself and of any services available through that Platform are subject to the Rules.

Other Terms and Conditions

• You may only have one (1) active user account at any one (1) time.
• By accepting any bonus cash, award, or offer associated with the Promotion, registered users agree to abide by the Terms and Conditions of this Promotion offer.
• You may not assign or transfer any or all of Your rights or obligations under the Rules.
• No third party shall have a right to enforce the Rules against The Sponsor.
• Failure by the Sponsor to enforce a right under the Rules does not result in waiver of such right.
• If any part of the Rules is found to be unenforceable as a matter of law, all other parts of the Rules shall be unaffected and shall remain in force.
• We may withdraw this Promotion at any time, for any reason, without notice. If We choose to withdraw this Promotion and You have already created an Account as part of this Promotion but have not yet claimed your bonus and the claim period has not yet concluded, you will still be able to claim your bonus until the claim period concludes. 
• Our determination and decision on all matters will be final and no correspondence will be entered into. Any dispute or situation not covered by the Rules will be resolved by Our management in a manner it deems to be the fairest to all concerned and, subject to the following section, that decision shall be final and binding on all players.
• You and We agree that the laws of New Jersey apply to the Rules and that any dispute between You and Us arising out of or in connection with these Rules or the Promotion will only be dealt with by the courts of New Jersey.
• If these New User Deposit Promotional Terms are translated into a language other than English, then the English version shall prevail where there is any inconsistency.
